Copyrights is an area of intellectual property law that protects original works of authorship that are created in tangible mediums. Copyrights law protect both published and unpublished works. Work is protected the moment it is created in a tangible form of expression. Examples of works that might come under copyright protection are songs, poems, movies, literary pieces, computer software, paintings, photos, poetry, architecture, and other written works.
Copyright registration is not required. Your work, remember, is protected the moment it is created. Registration, nevertheless, is recommended because it has a number of advantages, such as putting the public at large on notice of your creation. Registration is also particularly usefulness in the event any litigation arises out of the alleged copyrighted material.
Copyright registration is just one aspect of copyright law, and it is done to help protect the asset. However, after steps have been taken to identify and register an asset, enforcement of the copyright can become necessary. This requires vigilance. If a copyright dispute arises, the first step is to put the infringing party on notice and demand that the infringement stop. Negotiations at this stage can save the cost of litigation in the future. However, in some instances, litigation may become necessary, and a complaint can be filed in state or federal court.
Copyright litigation comes into play when two parties have a dispute, but not all copyright issues involve disputes. Sometimes parties come together to make a business deal, as is the case with copyright licensing. If, for example, you have employees who are creating work in the course of their employment, it would be wise to have an agreement in place regarding issues like who ultimately owns the work and under what circumstances it may be used in the future. A copyright licensing agreement can be used to cover issues such as these.
